Act
All references to the Act, as italicised, are references
to the Native Title Act 1993 (Cth) as amended, unless otherwise
stated.

Acts (or activities)

References to an 'act', where not italicised, are references to
any activity or grant in relation to any land or waters. For example,
an act includes an issue, variation or extension of a lease, licence,
permit, authority or instrument, or any activity that takes place
over an area such as installing water pipes or upgrading a road.
An act includes:
- the making, amendment or repeal of any legislation;
- the grant, issue, variation, extension, renewal, revocation or
suspension of a licence, permit, authority or instrument;
- the creation, variation, extension, renewal or extinguishment
of any interests in relation to land or waters;
- the creation, variation, extension, renewal or extinguishment
of any legal or equitable right, whether under legislation, a contract,
a trust or otherwise;
- the exercise of any executive power of the Crown in any of its
capacities, whether or not under legislation; and
- an act that has effect at common law or in equity.
